Phnom Penh : According to reports and information from local sources, local residents have expressed concern and suspicion over the construction of a solid structure, which is in the process of preparing a brick wall close to the mouth of the water release canal, located in Sangkat Chom Chao 2, Khan Por Sen Chey, Phnom Penh.
Based on actual images taken by citizens, there is evidence of construction of red brick walls and earth retaining walls, creating a strong structure that appears to be very close to the canal’s banks. This case has raised questions and concerns among the surrounding community about the safety of public waterways.
In this case, based on the legal aspect, according to Sub-Decree No. 198 of the Royal Decree on the Management of Coastal Land, River Land, Streams, Lakes, Ponds, Reservoirs and Canals, it clearly defines “public canal land” that must be kept at a safe distance (according to the type and size of the main canal or sub-canal) to allow technical officials to restore, maintain and release water to avoid flooding of citizens’ villages.
Sources from residents said that construction too close to the canal could pose a risk of canal bank collapse during heavy rains and could also reduce or affect the overall drainage system in the area.
However, this is just a suggestion and concern from a citizen source. As a media organization that acts as a mirror reflecting the true nature of society, we would like to strictly maintain our professional ethics by not concluding or alleging that the above construction is legally permissible or illegal, and we have no intention of inciting or defaming any individual.
This report is made in a constructive manner to respect the request to the local authorities of Chom Chao 2 Sangkat, as well as the experts of Por Sen Chey District Hall, to please help to inspect, measure, and verify the law in order to provide cleanliness to the construction owners and to ensure the protection of public canal land in accordance with legal principles.
